Co-ops UK publishes updated guidance on society law

Co-operatives UK has published a supplement to the second edition of the Handbook of Co-operative and Community Benefit Society Law. The Handbook, launched in 2014, is the only comprehensive legal textbook on society law. The Supplement covers developments in law and practice since the Handbook was published.

This supplement provides an update on developments since the enactment of the Co-operative and Community Benefit Societies Act 2014 and provides a commentary on FG15/12: Guidance on the FCA’s registration function under the Co-operative and Community Benefit Societies Act 2014, published in November 2015.

The supplement focuses on a number of areas including:

  • An analysis of the Financial Conduct Authority (FCA)'s role and its November 2015 guidance;
  • News of new case law such as on directors’ duties, informal unanimous decision-making in societies and achieving one member one vote in a company limited by shares
  • Guidance on the regulatory rules for credit unions in the PRA's Credit Union Rule Book
